1. ACCEPTANCE OF TERMS

By downloading, installing, or using the RideRunner mobile application (“App”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, do not use the App.

2. COMPANY INFORMATION

RideRunner is operated by Good Neighbourhood Pty Ltd, a company incorporated in Australia.

3. ACCEPTABLE USE POLICY & COMMUNITY STANDARDS

The RideRunner App and all associated services are intended for the safe and recreational use of motorized vehicles by adults who comply with local traffic laws. Users must adhere to a strict code of conduct, including but not limited to:

Prohibited Behavior: Users shall not use the service or platform to post, transmit, upload, or facilitate content that is illegal, abusive, harassing, hateful, defamatory, threatening, sexually explicit, racially insensitive, discriminatory, or promotes violence against any person or group.

Intellectual Property: All user-generated content (including profile images, team banners, names, and descriptions) must be original and owned by the user, or used with proper permissions. Users warrant that they have all necessary rights to submit such material.

Misrepresentation/Impersonation: Users shall not impersonate any person, entity, or group.

Moderation Rights: RiderRunner retains the sole right, at its absolute discretion, to monitor, moderate, remove, and restrict any content, account, or functionality that it deems violates these Standards or harms our community. This includes the right to suspend accounts without prior notice.

4. ASSUMPTION OF RISK & SAFE RIDING PRACTICES

By downloading, using, or relying upon the RiderRunner App (the “App”), you acknowledge and agree to the following:

Not an Endorsement: The App, its features, including leaderboards based on speed metrics, do not endorse, encourage, promote, or facilitate speeding, street racing, illegal riding, reckless operation of any vehicle, or dangerous behavior of any kind.

User Responsibility: You are solely responsible for the safe and law-abiding operation of your motorcycle and personal equipment at all times. You must comply with every local, state, and national traffic law, regardless of whether the App suggests otherwise.

Assumption of Risk: You acknowledge that operating a motorized vehicle inherently carries risks, including the risk of serious injury or death. By using this service, you assume full responsibility for these risks. The App is designed to assist in safe riding but cannot eliminate inherent dangers.

RideRunner is intended for recreational and hobby use only. Do not rely on the App for professional purposes, critical safety decisions, emergency situations (always call emergency services directly), or navigation in unfamiliar or dangerous areas.

5. KmPOINTS SYSTEM

5.1 Definition: “KmPoints” refers to a virtual, proprietary currency earned within the App based on activity (e.g., distance ridden).

5.2 Value: KmPoints are non-cash redeemable and hold no intrinsic monetary value outside of this App. They cannot be exchanged for real-world currency or goods unless explicitly authorized by RiderRunner via a dedicated redemption mechanism.

5.3 Forfeiture & Transferability: KmPoints are personal to the account owner, are non-transferable, and may be forfeited, reduced, or revoked by RiderRunner immediately upon: (a) breach of these Terms; (b) suspicious activity; (c) account termination for any reason; or (d) if required due to changes in law.

5.4 Not a Financial Product: The KmPoints system does not constitute an investment contract, financial product, or gambling service.

6. PREMIUM SUBSCRIPTIONS & BILLING

6.1 Purchase Agreement: Subscription purchases are governed by Apple’s App Store Terms and Google Play Developer Policy alongside these Terms. By subscribing, you agree to these terms.

6.2 Auto-Renewal: All subscriptions automatically renew at the end of the current billing cycle unless canceled by the user via your account settings on the respective platform.

6.3 Refunds & Cancellation: Subscription refunds are processed strictly according to the policies set by Apple and Google (the “Store Providers”). We reserve the right to deny refunds outside of these standard mechanisms. Users must cancel subscriptions through the Store Provider interface if they wish to prevent renewal.

6.4 Price Changes: RiderRunner reserves the right to change subscription pricing or features upon providing reasonable advance notice, where legally required.

7. USER-GENERATED CONTENT (UGC)

7.1 License Grant: By uploading any material to the App (including but not limited to avatar images, team banners, descriptions, names, “Team Profiles,” or ride logs), you grant RiderRunner a perpetual, non-exclusive, royalty-free, worldwide license to use, reproduce, modify, distribute, and display that content in connection with operating and promoting the App.

7.2 User Warranty & Indemnity: You warrant that you own all rights to the UGC you submit or that you have obtained all necessary licenses and permissions. You agree to defend, indemnify, and hold harmless RiderRunner from any claims arising out of your breach of this warranty or your use of infringing content (including copyright infringement).

7.3 Takedown Rights: If we receive a valid DMCA takedown request or similar notice, we reserve the right to remove the infringing UGC immediately and suspend associated account features pending investigation.

8. LOCATION SERVICES, TRACKING, AND PRIVACY

8.1 Data Collection: The App collects various personal location data (GPS) for the purposes of providing core features, including tracking your route and proximity to other users (Nearby Rider Map). You grant consent for continuous or intermittent background location services required for optimal function.

8.2 Consent Clarity: We commit to informing you when background tracking begins, when it stops, and what specific data is being shared. Data sharing with friends (nearby riders) is opt-in by the user in question.

8.3 Limited Scope of Use: Location data is used strictly for ride logging, leaderboards, group coordination, and immediate safety notifications. We do not sell raw location data.

8.4 Data Accuracy: All statistics and data provided are only as accurate as your device’s sensors and capabilities. Data should be used for recreational and hobby purposes only. Do not rely on App data for any critical decisions.

9. EMERGENCY SERVICES & SOS FEATURE DISCLAIMER

WARNING: THE SOS FEATURE IS NOT A SUBSTITUTE FOR EMERGENCY SERVICES. The “Crash Detection” and automated SOS feature are automated systems that rely on the App’s internal sensors, device battery life, network coverage, and GPS accuracy. We make NO GUARANTEE that an alert will successfully transmit, or that emergency services will be able to receive it. In any real emergency, you must call local emergency services (e.g., 000, 911, 112) directly. By using this feature, you acknowledge that failure of the system due to technical fault, poor signal, or device malfunction is possible and does not diminish your responsibility to seek professional help immediately.

These features depend on factors beyond our control including but not limited to: mobile network reception, internet connectivity, GPS signal strength, device battery life, device hardware capabilities, environmental conditions, and user settings and permissions.

10. IDENTITY VERIFICATION (KYC)

The use of identity verification services (such as Didit) is optional and provided purely for enhanced safety features and trust building within the community. We process this data to confirm your age, identity, and residency status. You acknowledge that:

No Guarantee: The identity verification service provides a best-effort assessment but does not guarantee absolute proof of identity.

Data Handling: Any personal data shared with third-party KYC providers is governed by their respective privacy policies and our commitment to secure data storage.

11. VIRTUAL CURRENCY & POINTS REDEMPTION

The redemption of KmPoints for Premium Subscriptions is subject to RiderRunner’s discretion and requires adherence to the billing terms set forth in Section 6 (Premium Subscriptions & Billing).

12. THIRD-PARTY SERVICES DISCLAIMER

RiderRunner utilizes third-party services, including Google Maps (for mapping data), Apple/Google Payment Systems (for IAP), and identity verification providers (Didit). While we take reasonable steps to ensure these services function correctly, RiderRunner is not liable for any service interruptions, inaccuracies, or failures arising from the use of such third-party components.

13. LIMITATION OF LIABILITY & STATUTORY GUARANTEES

TO THE MAXIMUM EXTENT PERMITTED BY LAW: Good Neighbourhood Pty Ltd, its directors, employees, contractors, and agents SHALL NOT BE LIABLE for:

  • Death, personal injury, or property damage
  • Accidents involving motorcycles or other vehicles
  • Failure of safety features to operate
  • Delayed or failed emergency responses
  • Loss of data or service interruptions
  • Any direct, indirect, incidental, special, or consequential damages

THIS LIMITATION APPLIES EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

However, we explicitly recognize that certain consumer guarantees under Australian Consumer Law (ACL) cannot be excluded. We will endeavor to comply with all mandatory statutory guarantees, but our liability is limited by law.

14. AGE RESTRICTIONS AND ELIGIBILITY

The user must be of legal age in the jurisdiction where they are using the App, and we strongly recommend a minimum operational age of 18 years due to the nature of operating motorized vehicles. By signing up, you affirm that you meet all local riding age requirements.

15. DATA PORTABILITY AND ACCOUNT CLOSURE

You have the right to export your ride data and personal information at any time by utilizing the features available in our settings menu. To close your account, we will permanently delete your associated user data (including ride logs, team history, and uploaded UGC) within 30 days of receiving a verified deletion request, subject to mandatory law retention requirements.

16. MATERIAL CHANGES NOTICE & TERMINATION

RiderRunner reserves the right to make material changes to these Terms at any time. For changes that materially impact your use of the service (e.g., significant feature removal or fee increases), we will notify you via in-app notification and/or email at least 30 days prior to the change taking effect. Your continued use after such notice constitutes acceptance of the new Terms.

We may terminate your access to the App at any time without notice for any reason, including breach of these Terms.

17. INDEMNIFICATION

You agree to indemnify and hold harmless Good Neighbourhood Pty Ltd from any claims, damages, losses, or expenses arising from your use of the App or breach of these Terms.

18. NO WARRANTIES

THE APP IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO: merchantability, fitness for a particular purpose, accuracy or reliability, and uninterrupted operation.

19. SERVICE AVAILABILITY

We do not guarantee that the App will be available at all times. Service may be interrupted for maintenance, updates, or technical issues.

20. USER RESPONSIBILITIES

You agree to: use the App at your own risk; comply with all applicable laws and traffic regulations; maintain appropriate insurance coverage; not rely solely on the App for safety or navigation; keep your device charged and properly configured; and provide accurate emergency contact information.

21. GOVERNING LAW

These Terms are governed by the laws of Australia. Any disputes will be subject to the jurisdiction of Australian courts.

22. SEVERABILITY

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

23. ENTIRE AGREEMENT

These Terms constitute the entire agreement between you and Good Neighbourhood Pty Ltd regarding the App.

BY USING RIDERUNNER, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND CONDITIONS.
